1. INTRODUCTION
- 1.1. This domain name www.siliconops.ai (“Platform”) is owned, maintained and operated by SILICON BUSINESS SOLUTIONS PRIVATE LIMITED, a company incorporated under the Companies Act, 2013, and having its registered office address at Silicon Business Solutions Pvt Ltd, Plot 22, BhavyaSree Building, Jayabheri Pine Valley, Gachibowli, Hyderabad – 500032 (“Company” which expression shall, unless it be repugnant to the context thereof, be deemed to include its successors, affiliates, and permitted assigns). The Company is inter alia, engaged in the business of providing software solutions, including but not limited through enterprise solutions, smart network, cybersecurity services to end users (“Users” or “you” or “your”) via. the Platform (“Business”).
- 1.2. The Company is committed to respecting the User’s online privacy and recognizes the need for appropriate protection and management of any information the User shares with the Company on the Platform. This privacy Policy (“Privacy Policy”) explains how the Company will collect, use, share and process information in relation to the services provided on the Platform.
- 1.3. This Privacy Policy shall be deemed to be incorporated into the terms of use (“Terms”) and shall be read in addition to the Terms.
- 1.4. By accepting this Privacy Policy, through an affirmative action, the User provides free, specific, informed, unconditional and unambiguous consent to the Company and understands and agrees to the collection, use, sharing and processing of Personal Information (defined below) as described herein. If the User provides the Company with personal information about someone else, the User confirms that (a) such information is accurate and up-to-date; (b) the User has provided such individual with all notices required under applicable law; and (d) the User obtained all necessary consents, permissions and authorisations, or have another valid legal basis under applicable law, to enable us to collect, use, disclose and otherwise process such Personal Data in accordance with this Privacy Policy. This Privacy Policy applies to all the current and former visitors, Users and others who access the Platform.
2. SCOPE
- 2.1. This Privacy Policy is an electronic record in the form of an electronic contract formed under the Information Technology Act, 2000 (‘IT Act”) and the Digital Personal Data Protection Act, 2023 and the rules made thereunder (“DPDP Act”). This Privacy Policy does not require any physical, electronic, or digital signature.

By agreeing to this Privacy Policy, accessing or using the Platform or giving the Company the User’s information or otherwise clicking to accept this Privacy Policy, if and when prompted on the Platform, the User undertakes that the User has the capacity to enter into a legally binding contract vide. this Privacy Policy, which constitutes a legally binding document between the User and the Company under applicable law, in particular, the Indian Contract Act, 1872. The Company will collect and process the User’s personal information and third-party data carefully, only for the purposes described in this Privacy Policy and only to the extent necessary as defined herein and within the scope of the applicable legal regulations. This Privacy Policy seeks to ensure that any Personal Information or third-party information handled by the Company is managed in a way that is ethical, compliant and adheres to best industry practices.
- 2.3. Please read the terms and conditions of this Privacy Policy carefully, before accepting the same and/or accessing or using the Platform. By accessing or using the Platform including its services or otherwise clicking to accept this Privacy Policy, if and when prompted on the Platform, the User agrees to the terms of this Privacy Policy. If the User is accepting this Privacy Policy on behalf of another person, the User represents and warrants that the User has full authority to bind such person to these terms. If the User is accepting this Privacy Policy on behalf of a child or person with disability, the User represents and warrants that the User is a parent or legal guardian or care taker of such a child or person with disability/diseases, as the case may be.

This Privacy Policy describes the types of Information (defined below) the Company collects, why and how the Company uses the Information, with whom the Company shares it, and the choices the User can make about the Company’ use of the Information. This Privacy Policy also describes the measures the Company takes to protect the security of the Information and how the User can contact the Company about its privacy practices.
- 2.5. This Privacy Policy describes the Company’s current data protection policies and practices and may be amended/updated from time to time. The Company will notify the User at least once in a year, or whenever there is a change in the Privacy Policy, by email or by posting a conspicuous notice on the Platform regarding its the then applicable data protection policies. The Privacy Policy shall come to effect from the date of such update, change or modification. It is recommended that the User regularly checks this Privacy Policy to apprise the User of any updates. The User’s acceptance or continued use of the Platform or provision of data or information thereafter will imply the User’s unconditional acceptance of such updates to this Privacy Policy.
3. TYPES OF INFORMATION
- 3.1. Personal Information: Personal Information means any information that may be used to identify an individual, including, but not limited to, the first and last names, telephone number, e-mail address, company or organization name, contents of messages or communication submitted through the Platform. The Company limits the collection of Personal Information to that which is necessary for its intended purpose.
- 3.2. Non-Personal Information: Non-personal information means information that does not specifically identify an individual, but includes information such as browser type, the URL of the previous websites the User visited, the User’s Internet Service Provider (ISP), operating system and the User’s Internet Protocol (IP) address. The Company may gather any non-personal information regarding how many people visit the Platform, the pages they visit, their IP address, browser types and versions, time zone settings and locations, operating systems, device, connection information, screen resolution, usage statistics, default communication applications and other technology on the devices that the User uses to access the Platform (“Non-Personal Information”). The Company may also collect Non-Personal Information that the User voluntarily provides, such as information included in response to a questionnaire, or a survey conducted by the Company.

Usage Information: Usage Information includes without limitation all data and information collected automatically through the Platform (or through the third party analytics service providers), by use and access of the Platform in the nature of system administrative data, statistical and demographical data, and operational information and data generated by or characterizing use of the Platform including without limitation Non-Personal Information, cookies, Platform traffic, time spent on the Platform, number of visits to the Platform and other similar information and behaviour indicating the mode and manner of use of the Platform (“Usage Information”).
- 3.4. Personal Information, Non-Personal Information, and Usage Information hereinafter shall collectively be referred to as “Information”.
4. COLLECTION OF INFORMATION
- 4.1. The Company may collect Information from the User for the specified purpose when the User: (a) visit the Platform; (b) voluntarily participate in campaigns conducted by the Company or respond to questionnaires published by the Company on the Platform (if any); and/or (c) voluntarily completes a survey or provide feedback in relation to the services provided by the Company.
- 4.2. The User hereby acknowledges and agrees that all Information is provided by the User to the Company voluntarily and the Information provided by the User is not subject to any undue influence.
- 4.3. The Company may use cookies to monitor the Platform usage in accordance with paragraph 11 of this Privacy Policy including, without limitation, to enhance the User’s experience when the User uses the Platform.
- 4.4. The Company may also collect Non-Personal Information based on the User’s browsing activity and in relation to the User’s use or access to the Platform like the User’s Internet Protocol (IP) address, the User’s operating system, the User’s prior search results, etc.
- 4.5. Information collected by the Company from a particular browser or device may be used with another computer or device that is linked to the browser or device on which such Information was collected.
5. PURPOSE OF PROCESSING
- 5.1. The Company may use the Information the User provides to (a) respond to the User’s queries on the Platform; (b) provide the User with the information about services available on the Platform and offer the User any other services that the Company believes may be of interest to the User; (c) resolve any glitches on the Platform including addressing any technical problems; (d) improve the services and content on the Platform and the User’s experience of navigating through the Platform; and (f) manage the Company’s’ relationship with the User.
- 5.2. The Company may use the Information to monitor the User’s use of the Platform and may review and analyse the Information provided by the User to provide the User with customized services.
- 5.3. The Company may use the User’s Non-Personal Information or Usage Information for marketing purposes and internal business purposes, such as data analysis, research, developing new services and/or features, enhancing and improving existing services and identifying usage trends. All data used and produced in analysis will be in an anonymised form and can be used by the Company for developing marketing strategies and educational/research or publication purposes.
- 5.4. When the User sends an email message or otherwise contacts the Company through the Platform, the Company may use the Information provided by the User to respond to the User’s communication by way of messages on the Platform, Short Message Service (SMS), WhatsApp voice and video calls, email, in-person or through any other communication channels that the Company may deem fit. The Company may also archive such Information and/or use it for future communications with the User to inform the User regarding updates, newsletters, offers, new services and promotions.
6. INFORMATION SHARING AND CROSS BORDER TRANSFERS
- 6.1. The Company maintains the User’s Information in electronic form on its servers. The Information is made accessible to employees, agents or partners of the Company and third-parties only on a need-to-know basis.
- 6.2. The Company may share the User’s Personal Information with its employees, affiliates, contractors, service providers, agents, consultants and other third parties strictly on a need-to-know basis and only to the extent necessary for the purposes described in this Privacy Policy, including for providing, operating, maintaining, improving and supporting the services. Any person or entity with whom the Company shares your Personal Data will be required to process such Personal Data only for the specified purpose and in accordance with applicable law, appropriate confidentiality obligations and reasonable security safeguards. The Company does not sell or otherwise disclose your Personal Data to third parties except as described in this Privacy Policy, where required for providing the services, to comply with applicable law, to enforce our legal rights, or where otherwise permitted or required under applicable law.
- 6.3. The Company is headquartered in India and primarily processes data within India. Where Personal Data is transferred outside India, for instance, to cloud service providers or partners operating in other jurisdictions, the Company ensures that:
- i. such transfers are made to countries or entities that provide an adequate level of protection for Personal Data, consistent with requirements under the DPDP Act and rules notified thereunder;
- ii. appropriate contractual safeguards (such as data processing agreements) are in place; and
- iii. we obtain any necessary regulatory approvals required under Indian law.
7. THIRD PARTY SERVICE PROVIDERS
- 7.1. The Company may engage third party vendors and/or contractors to perform certain support services, including, without limitation, fulfilment of the User’s service requests, software maintenance services, web hosting services and such other related services which are required by the Company to provide its services efficiently. These third parties may have limited access to Information. If they do, this limited access is provided so that they may perform these tasks for the Company and they are not authorized by the Company to otherwise use or disclose Information, except to the extent required by law.
- 7.2. The Platform may contain links and interactive functionality interacting with the websites of third parties. The Company is not responsible for and has no liability for the functionality, actions, inactions, privacy settings, privacy policies, terms, or content of any such websites. Before enabling any sharing functions to communicate with any such websites or otherwise visiting any such websites, the Company strongly recommends that the User reviews and understands the terms and conditions, privacy policies, settings, and information-sharing functions of each such third-party website
8. DISCLOSURE TO ACQUIRERS
The Company may disclose and/or transfer Information to an investor, acquirer, assignee or other successor entity in connection with a sale, merger, or reorganization of all or substantially all of the Company’ equity, business or assets.
9. YOUR RIGHTS
- 9.1. Subject to applicable law, you have the following rights in relation to your Personal Data:
- i. Right to Access Information: You have the right to obtain from the Company, information regarding the Personal Data being processed by the Company, including a summary of such Personal Data, the processing activities undertaken in relation to such Personal Data, and details of any third parties with whom such Personal Data has been shared, in accordance with applicable law.
- ii. Right to Correction, Completion and Erasure: You have the right to request correction of inaccurate or misleading Personal Data, completion of incomplete Personal Data, and erasure of your Personal Data that is no longer necessary for the purpose for which it was processed, subject to applicable law and our legal or regulatory obligations.
- iii. Right to Withdraw Consent: Where the processing of your Personal Data is based on your consent, you may withdraw such consent at any time by contacting us using the details provided in this Privacy Policy or through any consent management mechanism made available by the Company. Withdrawal of consent shall not affect the lawfulness of processing carried out before such withdrawal.
- iv. Right to Grievance Redressal: You have the right to seek redressal of any grievance relating to the processing of your Personal Data by contacting the Company’s Grievance Officer through the details provided in this Privacy Policy.
- v. Right to Nominate: You may nominate another individual who may, in the event of your death or incapacity, exercise your rights under applicable data protection laws.
- 9.2. To exercise any of the above rights, please contact us using the details provided in the "Grievance Redressal" section of this Privacy Policy. The Company may take reasonable steps to verify your identity before processing your request. The Company will respond to your request in accordance with applicable law.
10. TERM OF STORAGE OF PERSONAL INFORMATION
- 10.1. The Company shall store the User’s Personal Information at least for such period as may be required and permitted by law or for a period necessary to satisfy the purpose for which the Personal Information has been collected. These periods vary depending on the nature of the information and the User’s interactions with the Company.
- 10.2. The User agrees that the User will not submit any false information or any illegal or damaging content to the Platform.
- 10.3. The Company reserves the right to terminate access to or the ability to interact with the Platform in response to any concerns the Company may have about false, illegal, or damaging content or for any other reason, in its sole discretion.
11. COOKIES
- 11.1. The Company uses cookies and/or other tracking technologies to distinguish the User from other users of the services and to remember the User’s preferences on the Platform. This helps the Company to provide the User with a good experience when the User uses the services on the Platform and also allows the Company to improve such services. Cookies are text files the Company places in the User’s mobile phone, tablet or other devices to store the User’s preferences. Cookies, by themselves, do not collect your Personal Information unless the User chooses to provide this information to the Company. Cookies are designed to hold a marginal amount of data . However, once the User chooses to furnish the Platform with Personal Information, this Personal Information may be linked to the data stored in the cookie. The Company uses cookies to understand Platform usage and to improve the content and offerings on the Platform. The Company may also use cookies to offer the User programs or services. Cookies may be placed on the Platform by third-parties as well, the use of which the Company does not control.
- 11.2. Session cookies are automatically deleted from the User’s hard drive once a session ends, and most cookies are session cookies. The User may decline the cookies, however, if the User declines the cookies, the User may be unable to use certain features on the Platform and the User may be required to re-enter the User’s password frequently. The User may opt to leave the cookies turned on.
12. PROTECTION OF INFORMATION
- 12.1. The Company has taken adequate technical, organisational and security measures to protect the security of Information and to ensure that the User’s choices for its intended use are honoured. The Company takes robust precautions to protect the User’s data from loss, misuse, unauthorized access or disclosure, alteration, or destruction in accordance with applicable law.
- 12.2. The Company considers the confidentiality and security of the User’s information to be of utmost importance. It therefore uses industry standards, and physical, technical and administrative security measures to keep Information confidential and secure and the Company will not share the User’s Information with third parties, except as otherwise provided in this Privacy Policy.
- 12.3. While the Company takes reasonable measures to protect Personal Data, no method of transmission over the internet or electronic storage is completely secure. Accordingly, the Company cannot guarantee absolute security of Personal Data.
- 12.4. The Company shall not be responsible for any unauthorised access to or loss of Personal Data resulting from circumstances beyond Company’s reasonable control, including failures of telecommunications networks, internet service providers, malicious attacks by third parties despite reasonable security safeguards, or unauthorised access to your device, account credentials or systems attributable to your acts or omissions.
- 12.5. Nothing in this Privacy Policy shall be construed as limiting or excluding any rights or obligations that may apply under applicable law. In the event of a Personal Data breach, the Company shall take such measures as may be required under applicable law including providing notice to you and Data Protection Board of India.
13. PERSONAL DATA OF MINOR
14. LIMITATION OF LIABILITY
- 14.1. The Company shall not be liable to the User for any loss of profit, production, anticipated savings, goodwill or business opportunities or any type of direct or indirect, incidental, economic, compensatory, punitive, exemplary or consequential losses arising out of performance or non-performance of its obligations under this Privacy Policy.
- 14.2. The Company is not responsible for any actions or inactions of any third parties that receive the User’s Information.
- 14.3. Notwithstanding anything contained in this Privacy Policy or elsewhere, the Company shall not be held responsible for any loss, damage or misuse of the User’s Information, if such loss, damage or misuse is attributable to a Force Majeure Event. The term “Force Majeure Event” shall mean any event that is beyond the Company’s reasonable control and shall include, without limitation, sabotage, fire, flood, explosion, acts of God, civil commotion, strikes, lockouts or industrial action of any kind, riots, insurrection, war, acts of government, computer hacking, civil disturbances, unauthorised access to computer data and storage device, computer crashes, breach of security and encryption, pandemic or national/state lockdown due to any reason and any other similar events not within the Company’s control and which the Company is not able to overcome.
15. OPT-OUT
Once the User uses or accesses the Platform, the User may receive communications, including but not limited to WhatsApp, Instagram, Telegram, Short Message Service (SMS), voice calls, video calls, e-mails and other digital communications. The User has the option to ‘opt-out’ of all newsletters and other general promotional communications from the Company by way of links provided at the bottom of the mailers or by contacting the customer service team. It is hereby clarified that in the event of such opt-out, communications pertaining to services shall continue. The Company respects the User’s privacy and in the event that the User chooses to not receive such mailers, the Company shall take all adequate steps to remove the User from such lists. However, the User will not be able to opt-out of receiving administrative messages or customer service responses.
16. GOVERNING LAW
- 16.1. In the event of any Personal Data breach or violation of any of its rights and obligations under this Privacy Policy by the Company, you shall have the right to make a complaint to the Data Protection Board to investigate the alleged violation.
- 16.2. This Privacy Policy shall be governed by and interpreted and construed in accordance with the laws of India. The place of jurisdiction shall exclusively be Hyderabad.

18. MISCELLANEOUS
The Company may update, amend or modify this Privacy Policy from time to time to reflect changes in our business practices, legal or regulatory requirements, or the services offered by the Company. Any revised version of this Privacy Policy will be made available on the Platform and will become effective from the date of publication, unless otherwise specified. You are encouraged to review this Privacy Policy periodically to stay informed about our data processing practices.
If any provision of this Privacy Policy is held to be invalid, illegal or unenforceable by a court or competent authority, such provision shall be severed and the remaining provisions shall continue in full force and effect.
This Privacy Policy should be read together with the Terms and any other policies or notices made available on the Platform. In the event of any inconsistency between this Privacy Policy and any specific privacy notice provided in relation to a particular service, the specific privacy notice shall prevail to the extent of such inconsistency.
